1. Limit of E-Gateway liability. This system is designed to merely electronically record transaction details (purchaser name, email address and credit card details). Mantis Technologies accepts no responsibility for the delivery of the transactions to the E-Gateway server. Mantis Technologies accepts no responsibility for the information stored on the E-Gateway server.
To the extent permitted by law, Mantis Technologies excludes all representations and warranties, express or implied, other than those contained in these terms and conditions. Where Mantis Technologies is found to be liable for breach of any warranty or condition implied by statute and which Mantis Technologies cannot lawfully exclude, Mantis Technologies 's liability is limited (to the extent permitted by law) at the option of Mantis Technologies to the following:
(a) in the case of goods supplied or offered by Mantis Technologies:
(i) to the supply of those goods again; or
(ii) to the payment of the cost of having those goods supplied again; or
(b) in the case of services supplied or offered by Mantis Technologies:
(i) to the supply of the services again; or
(ii) to the payment of the cost of having services supplied again.
Mantis Technologies, its directors and its employees accept no liability for any loss (including loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction), or injury or any direct, indirect, consequential, special, punitive, or other damages caused by or as a result of:
(c) your use of or inability to use any Product or any Mantis Technologies or E-Gateway website;
(d) any virus or other harmful, or potentially harmful, code which may be transmitted in connection with use of the Products or any E-Gateway or Mantis Technologies websites;
(e) Mantis Technologies's negligence or the negligence of any of its related directors, officers, employees, academic providers or agents.
You indemnify Mantis Technologies, their officers and employees from and against all:
(f) liability for or in respect of any physical injury (including death) to persons;
(g) damage to property; and
(h) other liability, damage or loss;
insofar as the injury, damage or other liability, damage or loss is attributable to your negligence, breach of these terms and conditions, or unlawful or wilful action in connection with these terms and conditions, their performance, or the failure to perform them.
2. Misuse of E-Gateway. Any fraudulent or damaging activities or attempts to comprise the E-Gateway service will lead to immediate termination of this contract.
3. I understand and agree to all fee structures as outlined on the E-Gateway signup page. Located at https://secure.egateway.com.au/signup.aspx I understand that these prices may change at any time without notice.
4. Termination. Your failure to comply with the terms of this agreement shall terminate your account and this Agreement. Sections 1,2 and 3 shall survive any termination of this Agreement. Termination is required in writing 7 days prior.
